Prohibited & Restricted Items

1. Overview

This policy lists categories of items that may not, or may only conditionally, be listed on Sellexa. It applies to every seller. Sellers are responsible for ensuring listings are legal in the seller's location, the buyer's location, and any jurisdiction the item passes through. Lack of awareness of the law is not a defence.

Serious or repeated breaches result in listing removal, account suspension, or permanent termination under the Seller Misconduct & Enforcement Policy, and may be reported to law enforcement or a regulator.

2. Strictly prohibited

2.1 Controlled drugs and paraphernalia

  • All controlled drugs scheduled under the Misuse of Drugs Act 1971.
  • Cannabis, cannabis derivatives, and edibles, save for fully compliant CBD products that have been approved as Novel Foods by the FSA.
  • Drug paraphernalia intended for use with illegal drugs.
  • Nitrous oxide for recreational supply (Psychoactive Substances Act 2016, MDA 2023 amendment).

2.2 Stolen or tampered goods

  • Stolen property; goods obtained by fraud or deception.
  • Items with removed, altered, or falsified serial numbers.

2.3 Weapons

  • Firearms, ammunition, firearm components, imitation firearms.
  • Knives within the scope of the Offensive Weapons Act 2019 (zombie knives, flick knives, gravity knives, butterfly knives, push daggers, swords, and similar).
  • Crossbows, stun guns, pepper sprays, body armour above civilian thresholds.
  • Explosives, fireworks above F2, and pyrotechnics outside permitted categories.

2.4 Counterfeit and infringing goods

  • Replicas sold as genuine; unauthorised reproductions; bootleg media.
  • Items infringing trade marks, copyright, or registered designs, see the Intellectual Property Policy.

2.5 Hazardous materials

  • Asbestos and asbestos-containing items.
  • Banned chemicals or toxic substances (REACH-restricted).
  • Radioactive materials; lithium batteries above carrier-permitted thresholds in postal mail.

2.6 CITES-restricted cultural items (high-risk for a cultural marketplace)

  • Ivory of any age (Ivory Act 2018, extremely narrow exemptions; we do not host any in v1).
  • Items containing materials from CITES-listed species, certain hardwoods (rosewood, ramin), tortoiseshell, certain feathers, coral, ivory carvings, items containing python or crocodile skin.
  • Taxidermy of CITES-listed species without an Article 10 certificate.
  • Cultural artefacts that may have been illegally exported from their country of origin (UNESCO 1970 Convention).

2.7 Live animals, human remains, body parts

We do not permit listings of live animals, human remains (including teeth, hair offered as such, ash), or body parts of protected species.

2.8 Illegal sexual content

Any depiction or facilitation of child sexual abuse, non-consensual intimate imagery, or other illegal sexual material is strictly prohibited and will be reported to law enforcement. See also the Restricted Content Policy.

2.9 Hate-promoting items

Items that glorify hatred, extremism, or designated terrorist organisations (Terrorism Act 2000, Online Safety Act 2023), see the Community Guidelines.

3. Restricted (allowed only with the right registrations or controls)

3.1 Cosmetics, MHRA / OPSS

Cosmetics sold on Sellexa must comply with the UK Cosmetic Products Regulation. They must have been notified on the UK Cosmetic Product Notification Portal (CPNP-UK / OPSS), have a Responsible Person established in the UK, and carry full ingredient (INCI) labelling. Skin-bleaching or hydroquinone products are prohibited.

3.2 Food & drink, FSA

Food sellers must follow the dedicated Food Sellers Policy including FSA / local authority registration, Natasha's Law allergen labelling, and PPDS rules.

3.3 Age-restricted goods (sellers must verify age or refuse the order)

Sellexa does not currently provide automated age verification at checkout. Until that ships, sellers must not list any of the following:

  • Alcoholic drinks (Licensing Act 2003).
  • Tobacco, e-cigarettes, vaping fluids, and herbal smoking products.
  • Knives and bladed articles other than ordinary kitchen knives sold to a verified buyer (Offensive Weapons Act 2019).
  • Lottery tickets, gambling-related products.
  • Solvents, glues, and aerosols sold for inhalation.

We will revisit this list when age verification (Stripe Identity or equivalent) is integrated.

3.4 Medicines and medical devices

Sellexa does not allow the sale of prescription-only medicines, pharmacy-only medicines, or medical devices regulated under the Medical Devices Regulations 2002 unless the seller is a registered pharmacy or licensed device supplier and the listing complies with MHRA rules. General-sale list (GSL) medicines may be listed only if the seller meets the MHRA distance-selling logo requirement.

3.5 Electrical goods

Electrical goods must carry UKCA / CE marking and meet the Electrical Equipment (Safety) Regulations 2016. Second-hand electrical goods must be PAT-tested or otherwise demonstrably safe.

4. Seller responsibility

By listing items you confirm that you have the right to sell them, that they comply with this policy and applicable UK law, that you hold any required licences, and that your listing description is accurate. You must remove any item that you discover to be prohibited.

5. Enforcement

  • Removal of listings.
  • Holding of payouts where there is a credible compliance risk.
  • Account suspension or termination under the Seller Misconduct & Enforcement Policy.
  • Reporting to UK regulators (FSA, OPSS/MHRA, Trading Standards, OFCOM, Border Force) or the police.
